The flip side of this: third party platforms enter into a contract to deliver. It doesnt matter if their supplier, the restaurant, cant do it - as a consumer, you entered into an agreement and expected it kept.
Pursuing a small amount through Australia's regulators is very tough. The ACCC doesnt care about the eatnow/menulog acquisition for example, despite the fact the former had great practices; the latter has tanked those rating; indicating consumers have, en masse, lost out. State regulators cant scale up. So these platforms shift their liability onto the public and small business; despite being the ones who made the offer and agreement first up.
Small businesses and consumers need stronger automated agents to represent their rights.
