But the problem is that the Tesla autopilot was following too close during traffic. Is the software faulty which means that Tesla is responsible? Or that the driver should have took over earlier when (s)he noticed that his car was following too close so (s)he is responsible. And if it is the 2nd, what is the point of the Tesla auto-follow when even when it works OK (before the accident), it breaks the law by following too close?</code></pre>

It must be the drivers responsibility, surely? As the captain of the vehicle, you are responsible for its safety via the actions you (or it) takes. (Mechanical&#x2F;electrical failure is of course different). If you don’t like this, don’t engage the system.
