It would be quite easy to claim that it was in fact created by a human, since a human was involved in the creation of the machine, in tuning its parameters, and in selecting the final image. In the other examples listed, there seems to be some external value in claiming the work had non human authorship. That an animal produced a piece, or that a jessage came from a spirit or a god, seems to make the work more valuable. Especially in the latter case, the court cannot have seriously believed that a spirit was writing the message. Yet authorship was denied, because it would be listed as spiritual. There was likely a similar impetus here, and the copyright office refused on similar grounds.
