To my understanding, this is about the fact that Bing and Microsoft Copilot (formerly "Bing Chat" - not GitHub Copilot) base results/snippets/answers on pages as they were when they were last indexed. So a repository, or any other page, that was initially public then later made private may still be in Bing's cache in the state that it was when it was public.
If that's really all this is, claiming "Copilot has access to private GitHub repositories" seems misleading. Could equally claim any cache (search engines, archives, Common Crawl, ...) has access to any "private" content. Selecting Copilot and GitHub makes it sound like Microsoft is granting it special access, rather than it just being a case of "search engines and RAG need caches to work, and outdated content hangs around in caches a while".
