I'm funding a board game on Kickstarter. The game is about innovation, and uses a "historical" scenario to be more concrete. Players choose Friendster, Myspace, Facebook or Twitter as their company and fight for dominance over the social media industry.
I'm making the game in Norway, and feel safe with regards to local copyright law. Someone, however, made the point that games could be held and or destroyed by US customs. I have done a little research and wonder whether this does not fall under fair and/or nominative use?
Here's a link to a picture of the game cards that mention the companies:
https://ksr-ugc.imgix.net/assets/003/712/821/bba8377999ac5c8a86910de76c7c93d2_original.jpg?v=1430490587&w=700&h=&fit=max&auto=format&q=92&s=fbaee50cf2f30f83829a98f102b241b9
The Kickstarter (for context): https://www.kickstarter.com/projects/44846941/playing-lean-relaunch-play-leaner
Any input would be appreciated!
